FEDERAL CRIMINAL DEFENSE
McBride defends clients in federal investigations and prosecutions in the Southern and Eastern Districts of New York, the District of Columbia, and the Southern District of Florida. His federal work runs from pre-charge investigations through detention hearings, motion practice, trial, and sentencing. He has secured the release of clients from federal custody, including clients previously denied bail multiple times, and obtained a sentence of less than five years in a prosecution involving multiple kilograms of drugs and weapons. He has represented more than 25 January 6 defendants and led the advocacy for their presidential pardons, which were granted in January 2025.
DEFAMATION & CIVIL LITIGATION
Joseph D. McBride represents plaintiffs and defendants in defamation actions and complex civil disputes involving substantial financial, professional, and reputational consequences. He litigates in court and represents clients in national and international media, coordinating legal strategy and public communications with the firm's in-house public relations department.
In Palm Beach County, Florida, McBride filed a defamation action in 2023 on behalf of Andrew and Tristan Tate, alleging that false accusations contributed to their detention in Romania. The case is scheduled for trial in early 2027.
In Los Angeles, after prosecutors declined to pursue criminal charges against Andrew Tate in 2025, citing insufficient evidence, McBride filed a $50 million cross-complaint alleging defamation and related claims.
Throughout both matters, McBride has served as counsel and public spokesperson for the brothers under sustained national and international media attention.
EXTRADITION & CROSS-BORDER DEFENSE
McBride has led the American legal team for Andrew and Tristan Tate since 2023 and directs their defense strategy across Romania, the United Arab Emirates, the United Kingdom, and the United States. With the international defense team, he secured the brothers' release from detention in Romania, and in February 2025 Romanian authorities lifted their travel restrictions, allowing their return to the United States. In the Southern District of Florida, McBride leads the defense against the United Kingdom's extradition request, including an eight-hour bond hearing and habeas corpus litigation.
CONGRESSIONAL MATTERS
McBride represents members of Congress and has represented multiple clients before congressional committees, including Alex Bruesewitz before the House Select Committee investigating January 6. He worked with more than 40 members of Congress to press for investigation, inspection, and policy changes at the D.C. Jail, and he resolves problems for public and private sector clients facing scrutiny on Capitol Hill.
CUSTODY, DETENTION & PRISON CONDITIONS
McBride represents clients held in jails and prisons in New York, Washington, D.C., Virginia, and Florida. He challenges conditions of confinement, litigates against the Federal Bureau of Prisons, wardens, and other correctional officials, and files habeas corpus petitions and motions for compassionate release.
